How to Get Additional Temporary Workers with the H-2B Visa Program
Hear from immigration attorney, Jennifer Grady, Esq. about her experience and recommendations for preparing a winning H-2B application. The Grady Firm attorneys have successfully helped employers in the hotel, ski resort, landscaping, forestry, restaurant, winery, and trucking industries bring workers from abroad to supplement their staff on a seasonal or full-time basis since 2018. In addition, Guest Speaker Wilfredo Reyes, Senior Consultant with USAID, discusses the H-2B program resources from El Salvador, as well as the Supplemental Visa cap for the Northern Triangle countries. He discusses the how USAID provides free recruitment services to US employers under the Northern Triangle Exception, which allows for supplemental visas once the annual cap limit is reached. USAID meets with and vets thousands of Salvadoran workers, sends qualified candidates to the US employer, and assists with fast-track consular processing and transportation of the workers to the US. What is the H-2B Visa? The H-2B program permits employers to temporarily hire non-citizens to perform non-agricultural labor or services in the United States. The employment must be of a temporary nature, such as a one-time occurrence, seasonal need, or intermittent need. Employers seeking H-2B workers must take a series of steps to test the U.S. labor market. They must also certify in their petitions that there are not enough U.S. workers who are able, willing, qualified, and available to perform the temporary work for which they seek a prospective foreign worker. In addition, employers must certify that employing H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers. The H-2B visa program requires a multi-step process with the Department of Labor, USCIS, and foreign consulates to obtain permission to bring foreign workers to the US for a specific time period. Time is of the essence, as we will be filing the first stage of our applications in early October for an April 1, 2024 worker start date. How are International Students Affected by Schools Changing to Online Classes?
International Students Must Take In-Person Classes Starting This Fall or Immediately Depart the US Under New ICE Order As COVID-19 cases continue to surge in many parts of the United States, Immigration and Customs Enforcement (ICE) has announced that international students studying in the United States pursuant to an F-1 Student Visa must take most of their classes in person or depart the country. In a sudden reversal to previous policy which permitted international students to participate in virtual classes as a way to prevent the spread of COVID-19, ICE’s new guidance will force international students to take most, if not all classes in-person. If an international student is facing a situation in which his or her school is not offering in-person classes, ICE suggests changing to a school that does permit in-person classes. If the student is unable to take in-person classes, they must depart the United States immediately. Several universities have filed lawsuits to stop this change before the July 15, 2020 deadline for schools to announce whether they will provide classes in person, online, or a hybrid method. This change can have major consequences for students who may be required to depart the US if their school changes to online-only classes. How does the 6/22 Presidential Proclamation Affect L-1, J-1, H-1B, H-2B, & Green Card Applications?
On Monday June 22, President Donald Trump signed an executive order suspending the issuance of visas in certain nonimmigrant (temporary) worker categories through the end of the calendar year 2020, extended an existing temporary ban on certain permanent visa categories through the end of the year, and ordered government agencies to investigate possible further work visa restrictions. The Order, which took effect immediately, covers H-1B Specialty Occupation workers, H-2B Seasonal workers, L-1A Multinational Executives and Managers, L-1B Multinational Specialized Employees, and J-1 Exchange Visitors. The Order also applies to the visas normally issued to the dependents of the impacted classifications. Also, in addition to temporarily suspending temporary work visas, the Order extends the President’s existing suspension on certain Immigrant (permanent) visa categories until the end of the year. All restrictions listed in the Order could potentially be extended past December 31, 2020 if the Trump Administration can demonstrate a continued need for the restrictions.
